Website Hosting Service Agreement

AGREEMENT between Website Technology Services, Inc. dba WT Digital Agency ("WT Digital"), and the customer ("Customer") purchasing hosting services.

1. Hosting Services

WT Digital will provide Customer with website hosting services as selected during the purchase process, including but not limited to:

Website hosting and server management

SSL certificate provisioning and management

Basic security monitoring and updates

Email support for hosting-related issues

Backup services as specified in the selected plan

2. Term

This Agreement shall commence on the date of purchase and shall continue on a month-to-month basis until terminated by either party upon thirty (30) days' prior written notice. Notice shall be deemed given on the day of mailing or email transmission.

3. Customer Responsibilities

Customer agrees to:

Provide accurate contact and billing information

Comply with all applicable laws and regulations

Not use hosting services for illegal activities, spam, or malicious content

Maintain current backups of website content and data

Notify WT Digital promptly of any security concerns or technical issues

4. Payment Terms

All hosting fees are billed monthly in advance

Payment is due upon receipt of invoice

Past due accounts are subject to interest charges at the maximum rate allowed by law

WT Digital may suspend services without notice in the event of non-payment

Customer must provide written notice of any billing objections within 20 days of invoice date

5. Data and Content Ownership

Customer retains ownership of all website content and data

WT Digital may temporarily store and backup Customer content as necessary to provide hosting services

Upon termination, Customer is responsible for retrieving all content and data

WT Digital will provide reasonable assistance with data transfer upon request

6. Service Limitations and Uptime

WT Digital strives to maintain 99.9% uptime but does not guarantee uninterrupted service

Scheduled maintenance may require temporary service interruptions with advance notice

WT Digital is not responsible for downtime caused by factors beyond its control

Service credits may be provided at WT Digital's discretion for extended outages

7. Confidentiality

WT Digital agrees to keep Customer information confidential and not disclose it to third parties except as required for service provision or by law. Customer data will be handled in accordance with WT Digital's privacy practices.

8. Limitation of Liability

Except in cases of gross negligence or intentional misconduct, WT Digital's liability to Customer is limited to a maximum of the hosting fees paid for the month in which the claim arises. WT DIGITAL'S SERVICES ARE PROVIDED AS-IS, WITH NO WARRANTIES OF ANY KIND EXPRESS OR IMPLIED.

9. Indemnification

Customer agrees to indemnify and hold WT Digital harmless from any claims arising from Customer's use of hosting services, including content posted, laws violated, or third-party claims related to Customer's website or activities.

10. Termination

Either party may terminate this Agreement with thirty (30) days written notice. Upon

termination:

Customer remains responsible for all fees incurred through the termination date

WT Digital will provide reasonable assistance with data transfer

All Customer data will be deleted from WT Digital servers after 30 days unless other arrangements are made

11. Modifications and Changes

Service plan changes may be requested with 30 days notice

Any modifications to this Agreement must be in writing

WT Digital may update terms with 30 days advance notice to Customer

12. Governing Law

This Agreement is governed by the laws of the State of Georgia. Any disputes will be resolved in state or federal courts presiding over Fulton County, Georgia, and Customer consents to jurisdiction and venue in those courts.

13. Technical Support

WT Digital will provide email support for hosting-related technical issues during regular business hours. Response times may vary based on the selected hosting plan and complexity of the issue.

14. Acceptable Use

Customer agrees not to use hosting services for:

Illegal activities or content

Spam or unsolicited email distribution

Malware, viruses, or malicious code

Excessive resource consumption that impacts other customers

Activities that violate the rights of others

Violation of acceptable use policies may result in immediate service suspension or termination.

By purchasing hosting services and checking the agreement box, Customer acknowledges reading, understanding, and agreeing to be bound by the terms of this Website Hosting Service Agreement.
